Naples Homeowner Association Rules

Most of Naples properties are within a homeowners association (HOA), a condo association, or both. Associations are ruled by their Declaration of Covenants, Articles of Incorporation and Bylaws. These documents outline how the associations will be governed. Sellers must provide buyers copies of the community’s governing documents and recent financial statements before a buyer can be locked into a purchase agreement. (See Naples Buying Process).

It is very important that buyers review these documents. Limitations on pets, type of vehicles, rentals, use by relatives, and many others are common.

Condo Associations

Homeowner Association (HOA)

An HOA governs single family home neighborhoods. Here the homeowner owns and is responsible for the maintenance of the building. Commonly the newer HOA’s take care of all the outside landscaping as part of the HOA fee. HOAs are also responsible for any common areas and the amenities.

Master HOA

In larger developments it is very common that a homeowner is member of their single family HOA or condo association and also a member of a master association. When a development has multiple single family home and/or condo neighborhoods, then there would be a Master association that governs the shared areas and amenities.

Pelican Marsh in North Naples has 28 separate single family home and condo neighborhoods. The master HOA takes care of all the common elements and amenities – boulevards, tennis courts, fitness club, entry gates, etc.

HOA and Condo Fees

Covent Garden for example, is a section in Twin Eagles where residents are member in one of the three condo associations. These three separate condo associations share the use of a common pool. Owners are members of their separate condo assoc. and a also member of the common pool association.

Covenant Garden residents are members in four separate associations, each with their governing rules:

  • Coven Garden Pool Recreation
  • Twin Eagles Master Association - responsible for the guard gate, roads, boulevards and common areas within Twin Eagles.
